leaf="">刚接触到这个案件的时候，我冒出的第一个念头是怎么又一个漏水案件？我刚到民一庭办案三个月，已经接到4个房屋漏水纠纷案件了。这类案件处理起来比较棘手，法官不是建筑行业的专业人士，房屋漏水原因比较复杂，查找漏水原因又是判断责任的主要依据，基本上都需要委托专业机构鉴定。在查出漏水原因后如果是被告方的责任，一种方式是判决被告承担修复义务，如果被告不履行，修复的事情就要在执行中解决了；另一种方式是判决由原告自行修复，那么又涉及修复费用的鉴定问题，案件审理周期比较长，想快速彻底解决问题难度很大。</span></p><p><span leaf=""><br/></span></p><p style="text-indent:2em;"><span leaf="">定分不易，止争尤难。这个案件的办案思路、司法策略虽然不一定具有可复制的意义，但司法理念是共通的，就是司法要有担当、有温度、有速度。这个案件的处理效果还是比较好的，各方当事人都很满意。主要体现在以下三个方面：一个是“快”，从立案到问题解决纠纷平息，用了仅仅72个小时，就解决了长达一年未能解决的问题；第二个是“省”，当事人仅花了1500元，省了不少鉴定费，如果没有及时处理，今后的损失还难以估量，可以说是花小钱办大事，当事人也很省心；第三个是“新”，不拘泥于以往审案的旧思路，通过现场勘验迅速找到问题症结，在司法规则框架内，果断在物业公司、法院见证下让原告垫付费用安排破墙修复，修复费用由被告承担，一揽子解决所有问题。</span></p></section></section></section></section></section></section></section><p>来源：福清法院</p><p><br/></p><link
