normal;">陈某向谢某出售案涉车辆后，虽以谢某的名义办理了临时牌照登记并提取车辆档案，但在事故发生时尚未向谢某交付车辆，故谢某依法尚未实际取得案涉车辆所有权，亦未取得对案涉车辆的管理与控制权，谢某对于本案的侵权不存在过错或承担赔偿责任其他法定情形。</p><p style="text-indent: 2em;white-space: normal;">在无特别约定的情况下，车辆的交付义务人为卖方。陈某对于依法不能上路行驶的车辆，未通过拖运等其他方式而采取上路自驾方式交付，存在过错，应当对案涉车辆交付过程中的侵权行为承担赔偿责任。案涉车辆登记所有人董某与实际管理人陈某均未提供证据证明双方对于案涉车辆交强险的购买存在特别约定，董某作为案涉车辆所有人，负有投保义务而未依法为车辆投保交强险，应在交强险责任限额范围内与陈某承担连带赔偿责任。</p></section></section></section><section
