padding: 0px; border: 0px; color: #0e408c; position: relative;" data-gid="7447778">仓山区</span>某地开设“国际牛霸”等微信赌博群，以微信抢红包比大小的方式进行赌博；7月，该团伙与翁某（另案处理）等人合伙开设“战狼”等微信赌博群。该团伙组织福州市<span class="candidate-entity-word entity-word" style="margin: 0px; padding: 0px; border: 0px; color: #0e408c; position: relative;" data-gid="109024">鼓楼区</span>等地<span class="candidate-entity-word" style="margin: 0px; padding: 0px; border: 0px;" data-gid="9956939">赌徒</span>约100余人赌博。2018年1到7月，“国际牛霸”群及与“战狼”群合并后已查明赌资人民币7387.7502万元。</p><p style="margin-top: 20px; margin-bottom: 20px; line-height: 30px; color: #222222; font-family: -apple-system, helvetica, sans-serif; font-size: 17px; text-align: justify; background-color: #ffffff;">其中，郑某谋为该团伙股东，于2018年7月退出股份，转为该赌博群“出图”、“托”等；王某鑫管理该团伙，并负责“拉手”（即往赌博群内拉入参赌人员）返水；王某妮为赌博群“机器人”，后兼统计每日赌资流水，于2018年6月退出该团伙；<span class="candidate-entity-word" style="margin: 0px; padding: 0px; border: 0px;" data-gid="1984516">河南</span>男子张某宾于2018年9月受雇为该团伙成员发放工资。</p><p style="margin-top: 20px; margin-bottom: 20px; line-height: 30px; color: #222222; font-family: -apple-system, helvetica, sans-serif; font-size: 17px; text-align: justify; background-color: #ffffff;">经审理查明，上述团伙的微信赌博群是通过抢红包比大小的方式进行赌博，<span class="candidate-entity-word" style="margin: 0px; padding: 0px; border: 0px;" data-gid="19273665">赌客</span>先将钱款转给财务，将钱款转换为分数后才能进行赌博，一元钱换成一分。转款方式由出图人员不定期在群里发送。赌客需要添加群里机器人和财务的微信号上下分。</p><p style="margin-top: 20px; margin-bottom: 20px; line-height: 30px; color: #222222; font-family: -apple-system, helvetica, sans-serif; font-size: 17px; text-align: justify; background-color: #ffffff;">上述赌博群盈利方式有两种，一种是通过开虚庄即自己开庄和赌客对赌<span class="candidate-entity-word" style="margin: 0px; padding: 0px; border: 0px;" data-gid="6445401">获利</span>，工作人员抢庄或者当虚假赌客时，实际没有充钱上分，由机器人直接把积分调到能够开庄或者参赌的金额，就可以和参赌的赌客进行赌博。如果输了，赔钱给赌客，如果赢了，等于没有成本赚到钱。平时有赢有输，输赢钱都归老板；另一种是通过<span class="candidate-entity-word" style="margin: 0px; padding: 0px; border: 0px;" data-gid="13833575">抽水</span>获利，除了自己虚假<span class="candidate-entity-word" style="margin: 0px; padding: 0px; border: 0px;" data-gid="17597488">坐庄</span>外，偶尔有参赌人员坐庄，就可以抽水获利。每局不论<span class="candidate-entity-word entity-word" style="margin: 0px; padding: 0px; border: 0px; color: #0e408c; position: relative;" data-gid="13410513">庄家</span>输赢都会向庄家抽取该局总赌资的8%作为抽水的费用。每局赌博的金额少时有几千，多的时候有二三万，每天能开三百局左右。</p><h1 style="margin-top: 20px; position: relative; text-align: justify; background-color: #ffffff;">此外，经审理查明，2020年6月7日至10日，张某宾还伙同王某东（另案处理）在明知放置的多卡宝设备系用于境外赌博、网络诈骗等违法犯罪活动的情况下，仍以每日600元工资受雇于孟某松（另案处理），将多卡宝设备放置在古田县、福清市、仙游县、永泰县大洋镇偏僻的山上，为境外诈骗、赌博分子提供电话卡转换服务等技术支持。张某宾获利1800元。</p><p style="margin-top: 20px; margin-bottom: 20px; line-height: 30px; color: #222222; font-family: -apple-system, helvetica, sans-serif; font-size: 17px; text-align: justify; background-color: #ffffff;"><span class="candidate-entity-word" style="margin: 0px; padding: 0px; border: 0px;" data-gid="318446">福州</span>鼓楼法院审理认为，郑某谋、王某鑫、王某妮、张某宾伙同他人以营利为目的开设赌场，其行为均已构成开设赌场罪，且情节严重；郑某谋起主要作用，是主犯，应当按照其所参与的全部犯罪处罚；其他三人起次要、辅助作用，是从犯，应当减轻处罚。张某宾明知他人利用信息网络实施犯罪，为他人犯罪提供通讯传输等技术支持，情节严重，其行为又构成<span class="candidate-entity-word entity-word" style="margin: 0px; padding: 0px; border: 0px; color: #0e408c; position: relative;" data-gid="15252453">帮助信息网络犯罪活动罪</span>，应予<span class="candidate-entity-word" style="margin: 0px; padding: 0px; border: 0px;" data-gid="9944931">数罪并罚</span>。</p><p style="margin-top: 20px; padding: 0px; border: 0px;" data-gid="9704420">判处</span>有期徒刑四年，并处罚金人民币五万元；王某鑫犯开设赌场罪，判处有期徒刑二年，并处罚金一万元；王某妮犯开设赌场罪，判处有期徒刑一年六个月，并处罚金五千元。</p><p style="margin-top: 20px; margin-bottom: 20px; line-height: 30px; color: #222222; font-family: -apple-system, helvetica, sans-serif; font-size: 17px; text-align: justify; background-color: #ffffff;">张某宾犯开设赌场罪，判处有期徒刑六个月，并处罚金二千元，犯帮助信息网络犯罪活动罪，判处有期徒刑八个月，并处罚金三千元，数罪并罚，决定执行有期徒刑一年一个月，并处罚金五千元。</p><p style="margin-top: 20px;
