2em;">福清市被征地农民养老保障制度实施办法</span></strong></p></section><section class="_editor" style="font-size:16px;margin-bottom:unset;"><p style="text-indent: 2em;"><strong>第一章 总则</strong></p></section><section class="_editor" style="font-size:16px;margin-bottom:unset;"><p style="text-indent: 2em;">第一条 为了规范我市被征地农民养老保障工作，根据《福建省人民政府办公厅关于做好被征地农民就业培训和社会保障工作的指导意见》（闽政办〔2008〕28号）和《福建省人力资源和社会保障厅 省财政厅 省国土资源厅 省农业厅关于福建省征地补偿和被征地农民社会保障办法实施过程中若干社会保障问题的处理意见》（闽人社文〔2017〕279号）等规定，结合我市实际，制定本实施细则。</p></section><section class="_editor" style="font-size:16px;margin-bottom:unset;"><p style="text-indent: 2em;">第二条 本办法所称被征地农民养老保障，是指农村集体所有的土地被政府征收后，依法安排被征地农民的社会保障费用，将被征地农民纳入城乡社会保障体系的行为。</p></section><section class="_editor" style="font-size:16px;margin-bottom:unset;"><p style="text-indent: 2em;">本办法所称的被征地农民，是指农村集体所有的土地被政府征收后，从该农村集体经济组织成员中产生的需要建立基本生活保障的人员。</p></section><section class="_editor" style="font-size:16px;margin-bottom:unset;"><p style="text-indent: 2em;">第三条 本市行政区域内被征地农民的养老保障适用本实施办法。</p></section><section class="_editor" style="font-size:16px;margin-bottom:unset;"><p style="text-indent: 2em;">第四条 我市被征地农民养老保障应当遵循即征即保、应保尽保、分类施保、逐步提高的原则，将被征地农民纳入城乡社会保障体系，确保被征地农民原有生活水平不降低，长远生计有保障。</p></section><section class="_editor" style="font-size:16px;margin-bottom:unset;"><p style="text-indent: 2em;">第五条 市政府统一负责全市被征地农民养老保障工作。有关部门和各镇（街）按照各自职责，共同做好相关工作，并负责对被征地农民养老保障工作的监督、协调和指导。</p></section><section class="_editor" style="font-size:16px;margin-bottom:unset;"><p style="text-indent: 2em;"><strong>第二章 被征地农民养老保障</strong></p></section><section class="_editor" style="font-size:16px;margin-bottom:unset;"><p style="text-indent: 2em;">第六条 保障范围</p></section><section class="_editor" style="font-size:16px;margin-bottom:unset;"><p style="text-indent: 2em;">（一）同时具备以下四个条件者，方可纳入我市被征地农民养老保障范围：</p></section><section class="_editor" style="font-size:16px;margin-bottom:unset;"><p style="text-indent: 2em;">1.依法征收农村集体耕地，市政府累计征用面积达70%及以上的农户；</p></section><section class="_editor" style="font-size:16px;margin-bottom:unset;"><p style="text-indent: 2em;">2.享有农村集体土地承包权；</p></section><section class="_editor" style="font-size:16px;margin-bottom:unset;"><p style="text-indent: 2em;">3.年满16周岁及以上具有农村集体经济组织所在地户籍，户籍在册的时间截点：2008年2月19日之前被征用耕地的，以2008年2月19日[即《福建省人民政府办公厅关于做好被征地农民就业培训和社会保障工作的指导意见》（闽政办〔2008〕28号）下发之日]户口簿中在册人口为准；2008年2月19日后被征用耕地的，按征地补偿安置方案批准之日确定且户口簿中在册人口为准；</p></section><section class="_editor" style="font-size:16px;margin-bottom:unset;"><p style="text-indent: 2em;">4.没有享受除城乡居民基本养老保险外其他法定社会养老保险待遇的。</p></section><section class="_editor" style="font-size:16px;margin-bottom:unset;"><p style="text-indent: 2em;">（二）对市重点项目征用耕地所涉及的且同时具备上述四个条件的农场；</p></section><section class="_editor" style="font-size:16px;margin-bottom:unset;"><p style="text-indent: 2em;">（三）对市重点项目所涉及的填海，填海面积达90%及以上，且耕地被征后人均耕地面积低于0.1亩，同时具备上述（二）（三）（四）款条件的农户。</p></section><section class="_editor" style="font-size:16px;margin-bottom:unset;"><p style="text-indent: 2em;">第七条 保障原则</p></section><section class="_editor" style="font-size:16px;margin-bottom:unset;"><p style="text-indent: 2em;">符合条件的我市被征地农民，按下列办法实行被征地农民养老保障政策：</p></section><section class="_editor" style="font-size:16px;margin-bottom:unset;"><p style="text-indent: 2em;">（一）年龄在16周岁及以上的被征地农民，应当依法参加城乡居民基本养老保险（以下简称城居保），并以养老补助方式参加被征地农民养老保障；在年满60周岁时，按规定享受城乡居民基本养老保险待遇，同时叠加享受被征地农民养老保障待遇；</p></section><section class="_editor" style="font-size:16px;margin-bottom:unset;"><p style="text-indent: 2em;">（二）被征地农民养老保障对象，不分男女，从年满60周岁的次月起按月享受养老保障待遇，直至身故（出现终止条件的除外）；</p></section><section class="_editor" style="font-size:16px;margin-bottom:unset;"><p style="text-indent: 2em;">（三）当前我市被征地农民养老保障待遇为每人每月350元，市政府将根据我市经济发展情况、农村生活水平和物价情况，适时调整被征地农民养老保障待遇标准；</p></section><section class="_editor" style="font-size:16px;margin-bottom:unset;"><p style="text-indent: 2em;">（四）年龄在16周岁以下的被征地农民，按照市政府有关规定一次性领取安置补偿费后，不再作为被征地农民参加被征地社会保障。</p></section><section class="_editor" style="font-size:16px;margin-bottom:unset;"><p style="text-indent: 2em;">第八条 保障对象</p></section><section class="_editor" style="font-size:16px;margin-bottom:unset;"><p style="text-indent: 2em;">（一）下列人员可计入被征地的保障对象：</p></section><section class="_editor" style="font-size:16px;margin-bottom:unset;"><p style="text-indent: 2em;">1.征地补偿安置方案批准之日，年满16周岁及以上依法享有农村土地承包经营权及户籍在村在册的人员；</p></section><section class="_editor" style="font-size:16px;margin-bottom:unset;"><p style="text-indent: 2em;">2.符合本条第一项的监内服刑人员；</p></section><section class="_editor" style="font-size:16px;margin-bottom:unset;"><p style="text-indent: 2em;">3.符合本条第一项规定条件的入伍士兵。</p></section><section class="_editor" style="font-size:16px;margin-bottom:unset;"><p style="text-indent: 2em;">（二）下列人员不计入被征地的保障对象：</p></section><section class="_editor" style="font-size:16px;margin-bottom:unset;"><p style="text-indent: 2em;">1.户口在农村集体经济组织的国家机关、事业单位在编人员，现役军官、符合政府安排工作的退役士兵；</p></section><section class="_editor" style="font-size:16px;margin-bottom:unset;"><p style="text-indent: 2em;">2.户口虽在农村集体经济组织，但经有关部门批准离退休、退职并领取离退休（退职）金的人员；</p></section><section class="_editor" style="font-size:16px;margin-bottom:unset;"><p style="text-indent: 2em;">3.经民政部门认定的特困人员；</p></section><section class="_editor" style="font-size:16px;margin-bottom:unset;"><p style="text-indent: 2em;">4.因其他原因将户口迁入本村（社区）的空挂户、寄住和暂住等，且不享有土地承包经营权的人员；</p></section><section class="_editor" style="font-size:16px;margin-bottom:unset;"><p style="text-indent: 2em;">5.水库库区移民按库区移民有关政策执行，不作为本办法的实施对象。</p></section><section class="_editor" style="font-size:16px;margin-bottom:unset;"><p style="text-indent: 2em;">（三）保障对象产生办法</p></section><section class="_editor" style="font-size:16px;margin-bottom:unset;"><p style="text-indent: 2em;">被征地农民保障对象具体名单首先是从被征地农民保障范围中产生。由村（社区）通知达到条件的农民持相关证件到所辖村（社区）申请参保，经村（社区）初审以及经村民会议或村民代表会议讨论通过后，在村（社区）公示7个工作日，然后报镇（街）联审确认参保资格，之后提交市人社局下属城居保中心为保障对象办理参保登记手续。</p></section><section class="_editor" style="font-size:16px;margin-bottom:unset;"><p style="text-indent: 2em;">第九条 被征地农民家庭人均收入低于我市城乡最低生活保障标准的，可以按照规定申请最低生活保障；若符合其他社会救助条件的，可按规定申请和享受相关待遇。</p></section><section class="_editor" style="font-size:16px;margin-bottom:unset;"><p style="text-indent: 2em;"><strong>第三章 被征地养老保障资金管理</strong></p></section><section class="_editor" style="font-size:16px;margin-bottom:unset;"><p style="text-indent: 2em;">第十条 被征地农民养老保障资金来源主要包括：</p></section><section class="_editor" style="font-size:16px;margin-bottom:unset;"><p style="text-indent: 2em;">（一）用地单位按规定缴纳养老保障资金，即工业用地、基础设施项目和公共建设项目用地的被征地农民社会保障金征收标准每亩暂按1.8万元，经营性用地每亩暂按6万元标准缴纳；</p></section><section class="_editor" style="font-size:16px;margin-bottom:unset;"><p style="text-indent: 2em;">（二）从国有土地有偿使用收入中提取养老保障金，我市暂按1%的比例提取，并随着经济发展状况适时调整提取比例；</p></section><section class="_editor" style="font-size:16px;margin-bottom:unset;"><p style="text-indent: 2em;">（三）省级补助资金；</p></section><section class="_editor" style="font-size:16px;margin-bottom:unset;"><p style="text-indent: 2em;">（四）资金账户中的增值收益，如利息收入。被征地农民养老保障资金银行存款（含财政专户存款）利率按照城居保资金存款利率标准执行。</p></section><section class="_editor" style="font-size:16px;margin-bottom:unset;"><p style="text-indent: 2em;">被征地社会保障实行福清市级统筹，设立被征地农民养老保障资金财政专户，实行专款专用；保障资金不足时，由市政府负责解决。</p></section><section class="_editor" style="font-size:16px;margin-bottom:unset;"><p style="text-indent: 2em;">第十一条 被征地农民养老保障资金用途：</p></section><section class="_editor" style="font-size:16px;margin-bottom:unset;"><p style="text-indent: 2em;">按规定及时足额支付被征地农民的养老保障金。</p></section><section class="_editor" style="font-size:16px;margin-bottom:unset;"><p style="text-indent: 2em;">第十二条 被征地农民保障对象具有下列情形之一的，终止被征地农民养老保障关系：</p></section><section class="_editor" style="font-size:16px;margin-bottom:unset;"><p style="text-indent: 2em;">（一）享受企业保或机关保养老待遇，从领取的当月终止；</p></section><section class="_editor" style="font-size:16px;margin-bottom:unset;"><p style="text-indent: 2em;">（二）丧失中华人民共和国国籍，从丧失国籍的次月终止；</p></section><section class="_editor" style="font-size:16px;margin-bottom:unset;"><p style="text-indent: 2em;">（三）死亡，从死亡的次月终止；</p></section><section class="_editor" style="font-size:16px;margin-bottom:unset;"><p style="text-indent: 2em;">（四）享受特困人员援助，从领取的当月终止。</p></section><section class="_editor" style="font-size:16px;margin-bottom:unset;"><p style="text-indent: 2em;">第十三条 暂停发放处置</p></section><section class="_editor" style="font-size:16px;margin-bottom:unset;"><p style="text-indent: 2em;">（一）疑似出现终止情形的，按“暂停发放—排查核实—跟进处置”原则处理；</p></section><section class="_editor" style="font-size:16px;margin-bottom:unset;"><p style="text-indent: 2em;">（二）监内服刑期间暂停发放保障待遇，刑满后的次月按现行标准发放被征地保障待遇，监内服刑期间不补发。</p></section><section class="_editor" style="font-size:16px;margin-bottom:unset;"><p style="text-indent: 2em;">第十四条 保障金申领</p></section><section class="_editor" style="font-size:16px;margin-bottom:unset;"><p style="text-indent: 2em;">参加被征地农民养老保障的，不分男女，年满60周岁（对年对月）的次月起按月享受被征地农民养老保障待遇。保障对象应在年满60周岁（对年对月）的前一个月，持身份证、第三代社会保障卡或合作金融机构的银行卡，到征地所在的村（社区）办理申领保障金手续（申请人可委托具有完全民事行为能力的人员代办，需另外提供委托书及受托人身份证），经镇（街）保障经办机构审核后及时上报到市城居保中心办理审批手续，市城居保中心从受理审批的次月起按月发放被征地农民养老保障金。</p></section><section class="_editor" style="font-size:16px;margin-bottom:unset;"><p style="text-indent: 2em;"><strong>第四章 职责分工</strong></p></section><section class="_editor" style="font-size:16px;margin-bottom:unset;"><p style="text-indent: 2em;">第十五条 市财政部门工作职责：</p></section><section class="_editor" style="font-size:16px;margin-bottom:unset;"><p style="text-indent: 2em;">（一）负责被征地农民养老保障资金的筹集、管理和保值增值。</p></section><section class="_editor" style="font-size:16px;margin-bottom:unset;"><p style="text-indent: 2em;">（二）及时足额核拨被征地农民保障金到经办机构支出专户，以保障被征地农民按时足额领取到保障金。</p></section><section class="_editor" style="font-size:16px;margin-bottom:unset;"><p style="text-indent: 2em;">第十六条 市自然资源和规划部门工作职责：</p></section><section class="_editor" style="font-size:16px;margin-bottom:unset;"><p style="text-indent: 2em;">（一）负责被征地农民养老保障对象征地情况的审核，做好被征地农民参加被征地农民养老保障资格的审查确认；</p></section><section class="_editor" style="font-size:16px;margin-bottom:unset;"><p style="text-indent: 2em;">（二）会同财政部门做好被征地农民养老保障资金的筹集工作；</p></section><section class="_editor" style="font-size:16px;margin-bottom:unset;"><p style="text-indent: 2em;">（三）认真做好相关政策宣传、解释、咨询和来访接待等工作。</p></section><section class="_editor" style="font-size:16px;margin-bottom:unset;"><p style="text-indent: 2em;">第十七条 市农业农村部门工作职责：</p></section><section class="_editor" style="font-size:16px;margin-bottom:unset;"><p style="text-indent: 2em;">（一）指导镇（街）按规定程序产生被征地农民具体名单，负责土地承包面积以及承包经营权的审查确认；</p></section><section class="_editor" style="font-size:16px;margin-bottom:unset;"><p style="text-indent: 2em;">（二）做好被征地农民参加被征地农民养老保障资格的审查确认；</p></section><section class="_editor" style="font-size:16px;margin-bottom:unset;"><p style="text-indent: 2em;">（三）认真做好相关政策宣传、解释、咨询和来访接待等工作。</p></section><section class="_editor" style="font-size:16px;margin-bottom:unset;"><p style="text-indent: 2em;">第十八条 市人社部门工作职责：</p></section><section class="_editor" style="font-size:16px;margin-bottom:unset;"><p style="text-indent: 2em;">（一）会同有关部门制定被征地农民养老保障相关政策；</p></section><section class="_editor" style="font-size:16px;margin-bottom:unset;"><p style="text-indent: 2em;">（二）负责经办被征地农民养老保障相关业务，包括参保登记、注销登记、支付被征地农民养老保障金等事务；</p></section><section class="_editor" style="font-size:16px;margin-bottom:unset;"><p style="text-indent: 2em;">（三）认真做好相关政策宣传、解释、咨询和来访接待等工作。</p></section><section class="_editor" style="font-size:16px;margin-bottom:unset;"><p style="text-indent: 2em;">第十九条 市公安部门工作职责：</p></section><section class="_editor" style="font-size:16px;margin-bottom:unset;"><p style="text-indent: 2em;">（一）负责审查被征地农民的户籍和人员年龄情况；</p></section><section class="_editor" style="font-size:16px;margin-bottom:unset;"><p style="text-indent: 2em;">（二）负责提供工作所需的被征地行政村（社区）居民人数、年龄结构状况、生存状况等相关信息数据；每月10日前向人社部门提供上月因加入外国国籍而注销户籍的人员名单信息；</p></section><section class="_editor" style="font-size:16px;margin-bottom:unset;"><p style="text-indent: 2em;">（三）会同镇（街）做好多享被征地农民养老保障待遇追讨工作。</p></section><section class="_editor" style="font-size:16px;margin-bottom:unset;"><p style="text-indent: 2em;">第二十条 市民政部门工作职责：</p></section><section class="_editor" style="font-size:16px;margin-bottom:unset;"><p style="text-indent: 2em;">负责对被征地对象中的特困人员身份信息的确认，每月10日前向人社部门提供上月特困人员名单信息。</p></section><section class="_editor" style="font-size:16px;margin-bottom:unset;"><p style="text-indent: 2em;">第二十一条 市监察委员会工作职责：</p></section><section class="_editor" style="font-size:16px;margin-bottom:unset;"><p style="text-indent: 2em;">负责征地补偿和被征地农民养老保障工作中的监督及违法案件的查处。</p></section><section class="_editor" style="font-size:16px;margin-bottom:unset;"><p style="text-indent: 2em;">第二十二条 市审计局工作职责：</p></section><section class="_editor" style="font-size:16px;margin-bottom:unset;"><p style="text-indent: 2em;">负责对被征地农民养老保障资金的投入、管理、使用等情况进行审计。</p></section><section class="_editor" style="font-size:16px;margin-bottom:unset;"><p style="text-indent: 2em;">第二十三条 所在镇（街）工作职责：</p></section><section class="_editor" style="font-size:16px;margin-bottom:unset;"><p style="text-indent: 2em;">（一）负责被征地农民养老保障对象的参保资格复核，并配合做好被征地农民养老保障业务协办工作；</p></section><section class="_editor" style="font-size:16px;margin-bottom:unset;"><p style="text-indent: 2em;">（二）负责做好多享被征地农民养老保障待遇追讨工作；</p></section><section class="_editor" style="font-size:16px;margin-bottom:unset;"><p style="text-indent: 2em;">（三）负责被征地农民养老保障对象生存情况的确认工作；</p></section><section class="_editor" style="font-size:16px;margin-bottom:unset;"><p style="text-indent: 2em;">（四）做好政策宣传及有关被征地养老保障争议协调处理工作。</p></section><section class="_editor" style="font-size:16px;margin-bottom:unset;"><p style="text-indent: 2em;">第二十四条 村（居）委会工作职责：</p></section><section class="_editor" style="font-size:16px;margin-bottom:unset;"><p style="text-indent: 2em;">（一）负责被征地农民养老保障工作的组织、发动、登记、初审和申报等事务；</p></section><section class="_editor" style="font-size:16px;margin-bottom:unset;"><p style="text-indent: 2em;">（二）协助做好被征地农民养老保障对象生存情况的确认工作；</p></section><section class="_editor" style="font-size:16px;margin-bottom:unset;"><p style="text-indent: 2em;">（三）协助做好多享被征地农民养老保障待遇追讨工作；</p></section><section class="_editor" style="font-size:16px;margin-bottom:unset;"><p style="text-indent: 2em;">（四）做好政策宣传及有关被征地养老保障争议协调处理工作。</p></section><section class="_editor" style="font-size:16px;margin-bottom:unset;"><p style="text-indent: 2em;">第二十五条 市发改、住建、规划、统计等部门按照各自职责，协同做好被征地农民养老保障的相关工作。</p></section><section class="_editor" style="font-size:16px;margin-bottom:unset;"><p style="text-indent: 2em;"><strong>第五章 附 则</strong></p></section><section class="_editor" style="font-size:16px;margin-bottom:unset;"><p style="text-indent: 2em;">第二十六条 本办法自公布之日起正式施行，有效期为十年。《福清市人民政府办公室关于印发福清市被征地农民养老保障试行办法的通知》（融政综〔2009〕179号）同时废止。本办法实施前的原已选定的保障方式（如被征地农民养老保障模式）保持不变。实施期间，若国家、省、市层面出台新政策规定，以新政策规定为准。</p></section><section class="_editor" style="font-size:16px;margin-bottom:unset;"><p style="text-indent: 2em;">第二十七条 本办法实施前，因出国出境定居或户籍迁出本省等已产生多领被征地农民养老保障待遇事实且尚未处理完毕的情况，在本办法实施后涉及权利义务调整时，按如下规则处理：</p></section><section class="_editor" style="font-size:16px;margin-bottom:unset;"><p style="text-indent: 2em;">（一）涉及需追缴多领被征地农民养老保障待遇的，以本办法实施时间为节点，此前发生的多领多享受金额，依据当时生效的政策法规进行追缴；</p></section><section class="_editor" style="font-size:16px;margin-bottom:unset;"><p style="text-indent: 2em;">（二）完成上述义务后，被征地农民自本办法实施之日起，按本办法规定享受被征地农民养老保障待遇。</p></section><section class="_editor" style="font-size:16px;margin-bottom:unset;"><p style="text-indent: 2em;">第二十八条 因公共利益需要实施集体土地征收时，若在土地征收程序启动前已完成房屋征收并办理户籍迁移，且符合以下条件的，可按本办法规定纳入被征地农民养老保障范围：</p></section><section class="_editor" style="font-size:16px;margin-bottom:unset;"><p style="text-indent: 2em;">（一）房屋已按公布的房屋征收补偿方案完成补偿安置并签订协议。</p></section><section class="_editor" style="font-size:16px;margin-bottom:unset;"><p
