1px;">已施行4年，有效规范了房屋征收补偿行为，但在房屋征收补偿实践中仍出现现行政策未明确、未涵盖的问题。为规范房屋征收补偿，需对现行政策作进一步完善和补充，以促进房屋征收补偿工作。</span></p><p><span leaf=""><br/></span></p><p><span style="font-size: 16px;letter-spacing: 1px;">为此，市住建局在征求各区意见后，草拟了《关于进一步完善房屋征收补偿政策的意见》。</span></p><p><span leaf=""><br/></span></p><p><strong><span style="font-size: 16px;letter-spacing: 1px;">二、主要内容</span></strong></p><p><span leaf=""><br/></span></p><p><span style="font-size: 16px;letter-spacing: 1px;">（一）</span><span style="color:#bf3300;"><strong><span style="font-size: 16px;letter-spacing: 1px;">修改给予奖励的条件</span></strong></span><span style="font-size: 16px;letter-spacing: 1px;">。按照《实施细则》规定，被征收人在签约期限内签订协议并搬迁的，可给予被征收人不同标准的各项奖励。实践中，因家庭纠纷、产权争议等原因，部分被征收人无法在签约期内签订协议，但自愿先行搬迁封房，支持项目建设，此类情形因未签订协议而不给予奖励，易导致被征收人拒绝交房，从而影响项目交地。为鼓励搬迁，促进项目净地交地，将给予奖励的条件修改为:被征收人在签约期限内搬迁封房的，可享受签约期各项奖励。</span></p><p><span leaf="">标准房型面积增设150平方米以上的房型</span></span></strong><span leaf="">。依据《实施细则》第九条第二款规定，标准房型面积为：45、60、75、90、105、120、135平方米。鉴于144平方米以上非普通住宅已取消，实践中也涉及征收140平方米以上大户型单元房，为满足被征收人住房刚性需求，标准房型面积增设150平方米的房型；同时，可根据征收实际及项目签约情况，增设150平方米以上的标准房型。</span></span></p><p><span leaf=""><br/></span></p><p><span style="font-size: 16px;letter-spacing: 1px;"><span leaf="">（四）</span><strong><span style="color: rgb(191, 51, 0);"><span leaf="">明确“孤寡老人”定义</span></span></strong><span leaf="">。依据《实施细则》第四十条规定，“被征收人或其直系亲属为<span class="">五保户</span>、低保户、孤寡老人的，给予每户3万元的装修补助”，但目前相关法律、法规均未对孤寡老人的情形作出规定，且民政部门、社区也无为孤寡老人出具证明的法定职责，导致该条规定执行无依据。为此，对孤寡老人的情形予以明确，具体为：孤寡老人是指年满60周岁、无配偶、无子女的老年人，无配偶、无子女依据民政部门出具的婚姻状况和公安机关出具的户籍关系证明进行认定。</span></span></p><p><span leaf=""><br/></span></p><p><span style="font-size: 16px;letter-spacing: 1px;">（五）</span><span style="color:#bf3300;"><strong><span style="font-size: 16px;letter-spacing: 1px;">进一步完善配给无房户基本住房需求面积的规定</span></strong></span><span style="font-size: 16px;letter-spacing: 1px;">。《实施细则》第二十三条对配给无房户基本住房需求面积的标准和条件做了详细规定，但在执行中仍存在以下需要完善的方面：</span></p><p><span leaf=""><br/></span></p><p><span style="font-size: 16px;letter-spacing: 1px;">1、进一步明确被征收房屋建造人无房的情形。参照公共租赁住房申请条件的规定，明确被征收房屋建造人及其家庭成员无房的情形，即被征收房屋建造人及其家庭直系亲属在本市五城区范围内无他处房屋，且在作出房屋征收决定或发布房屋征收补偿方案之日前5年无房产交易行为（含买卖、赠与、析产等），从而切实保障无房户“居者有其屋”，促进征迁。</span></p><p><span leaf=""><br/></span></p><p><span style="font-size: 16px;letter-spacing: 1px;">2、被征收人为农村经济合作社成员，婚前已享受征迁安置，对因结婚、生子新增人员给予补足居住保障。农村经济合作社成员婚前已享受征迁安置，因结婚、生子新增人员未享受过征迁安置或住房保障政策的，被征收人原享受征迁安置面积（含公摊补偿）不足按现有家庭人口配给无房户基本住房需求面积标准的，给予补足。</span></p><p><span leaf=""><br/></span></p><p><span style="font-size: 16px;letter-spacing: 1px;"><span leaf="">（六）</span><span style="color: rgb(191, 51, 0);"><span leaf=""><span textstyle="" style="font-weight: bold;">补充明确</span>1984年1月5日至2004年10月26日个人建造的<span textstyle="" style="font-weight: bold;">无产权非住宅房屋</span>和行政机关、事业单位、各类企业在自有土地使用权范围外建设的<span textstyle="" style="font-weight: bold;">无产权房屋的补偿标准</span></span></span><span leaf="">。《实施细则》对此类房屋的补偿未作具体规定，实践中补偿标准无依可循，项目审计时列入无文件依据。为规范补偿，对此类房屋补偿标准予以补充明确，具体为：根据不同结构房屋的重置价结合成新率给予补偿，在签约期限内搬迁交房的，另给予重置价结合成新率50%的搬迁奖励。</span></span></p><p><span leaf=""><br/></span></p><p><span style="font-size: 16px;letter-spacing: 1px;"><span leaf="">（七）</span><strong><span style="color: rgb(191, 51, 0);"><span leaf="">补充车位补偿的规定</span></span></strong><span leaf="">。《实施细则》对车位征收补偿未做规定，为填补车位补偿政策空白，对车位征收补偿进行补充完善，</span><span style="color: rgb(191, 51, 0);"><span leaf="">即征收车位可选择货币补偿，也可选择产权调换</span></span><span leaf="">；选择产权调换的，按市场评估价格结算差价，车位安置数量应在土地出让合同中予以明确，由指定单位回购。</span></span></p><p><span leaf=""><br/></span></p><p><span style="font-size: 16px;letter-spacing: 1px;"><span leaf="">（八）</span><strong><span style="color: rgb(191, 51, 0);"><span leaf="">推行被征收住宅面积折换安置房车位的补偿方式</span></span></strong><span leaf="">。为满足被征收群众对安置房车位的需求，推行被征收住宅面积折换安置房车位的补偿方式，依据就地安置房（含安商房）车位市场评估价格，由被征收人以被征收住宅货币补偿款等值置换安置房车位。</span></span></p><p><span leaf=""><br/></span></p><p><strong><span style="font-size: 16px;letter-spacing: 1px;">三、发文形式 </span></strong><span style="font-size: 16px;letter-spacing: 1px;"> </span></p><p><span style="font-size: 16px;letter-spacing:
